The Christmas rush may be over but for many that means the start of the self assessment rush. The January 31st self-assessment deadline is often approached with dread, however, completing your tax return form within the given time constraints can be achieved with the right amount of preparation and some simple, solid, professional advice, advises Bristol based accountancy practice Barnes Hunter.
 
How Will Gordon's Final PBR Affect You and Your Business
The last pre-budget report (PBR) from Chancellor Gordon Brown was surprising brief, yet contained many key points, according to Bristol based accountancy firm Barnes Hunter. While green issues dominated, underlying these were major financial and tax implications for local businesses and individuals to address.
 
Pre-Budget Report Summary 2006
This year’s Pre-Budget Report is almost certainly Gordon Brown’s last as Chancellor. On this occasion, his March 2006 Budget predictions for growth and borrowing have proved reasonably accurate, even if overall borrowing is still at an uncomfortably high level. While Mr Brown’s speech itself contained very few surprises, the supporting material issued by the Treasury and HM Revenue & Customs (HMRC) revealed a wide variety of important tax measures.
 
Pre-Budget Report
Gordon Brown has announced that he will make his Pre-Budget speech on Wednesday 6th December. Interest in the Chancellor’s speech is heightened this year as this may possibly be his last before Tony Blair steps down as leader.
 
New Companies Act Now Law
The Companies Act 2006 has finally received Royal Assent. The Act aims to simplify and improve company law and will take two years to implement.
 
Reforms to ISA and PEP Schemes
The Individual Savings Account (ISA) is a tax exempt savings account which allows individuals to invest up to £7,000 per annum. Income from these accounts is tax free.
 
VAT on Mobile and Computer Chips
A couple of months ago we reported that HMRC published guidance for businesses which buy and sell mobile phones, computer chips and certain other goods. The intention is to change the way in which VAT is dealt with on these items by making the purchaser responsible for paying the VAT using a system known as ‘reverse charge’. This means that the purchaser will be responsible for paying the VAT on the purchase of the goods and then will generally be able to claim a deduction for the input VAT suffered on the goods purchased.
 
Stamps Available Online
We reported a couple of months ago on the changes to the postal charging system which introduced pricing by size and weight.
 
Payroll Online Filing Incentive Available
HMRC have advised small employers who successfully filed their 2005/06 payroll end of year returns, P35 and P14s, online that they can now reduce their next PAYE payment by the £250 incentive payment. They advise that this can be done without waiting for HMRC confirmation that the amount is due.
 
VAT Fuel Charge Set to Rise
The EC has finally agreed the UK’s proposal to align the output VAT charge with the benefit in kind charge on the provision of private fuel assessable on the individual. The proposals and legislation were announced in the 2005 Budget and will be implemented from May 2007.
 
National Minimum Wage Changes
Many legislative changes are confined to April and October each year. 1 October 2006 sees the introduction of a number of changes not least of which are the increases to the national minimum wage (NMW) rates.
 
HMRC Won't Give Opinions on Trading Status of Companies
For a number of years taxpayers or their agents have been able to approach HMRC for their views as to whether a company was a trading company for business taper relief purposes. Many advisers have used this facility to great effect to ensure the availability of the 75% reduction in the taxable gain.
 
Recruitment and Age Discrimination
The Employment Equality (Age) Regulations 2006 take effect from 1 October 2006.ACAS has published a free guide for business owners to help them deal with the regulations.
 
Age Discrimination and PAYE
The Employment Equality (Age) Regulations 2006 become law from 1 October 2006 and this has far reaching implications some of which we have reported on previously. HMRC have published some guidance which looks at the implication of the legislation on payment of some statutory payments which employers make. Payments affected include statutory sick pay (SSP), maternity pay and paternity pay.
 
Tax Return Deadline
Lord Carter has revised his recommendations on bringing forward the personal tax return submission deadline.
 
Advisory Fuel Rates for Company Cars
HMRC have announced new rates for journeys on or after 1 July 2006. These rates apply to company car drivers who are reimbursed for business miles driven.
 
£250 Tax Free Payments for Online Filing
HMRC have advised employers with less than 50 employees who filed their end of year returns online for the year ended 5 April 2006 that they can deduct the £250 tax free compensation payment they are due from their next payment of PAYE.

Last month we reported on the proposed inheritance tax (IHT) changes for trusts. The professional bodies have been lobbying HMRC and the government to reconsider the rules and appear to have had some success. The legislation is being amended on its way through parliament.
 
Tax Return Deadline
Last month we updated you on reaction to the surprise announcement, made on Budget Day, of the proposal to bring forward the tax return submission deadline from 31 January to 30 September for paper returns and 30 November for electronic ones. The professional bodies have been campaigning against the recommendations made as part of Lord Carter’s review.
 
Pensions White Paper
The long awaited White Paper was released on 25 May. It contains many proposals which would change the pensions system quite radically.
 
Proposed Trust and Tax Return Changes
Last month we reported on the proposed inheritance tax (IHT) changes for trusts. The professional bodies are lobbying HMRC and the government to reconsider the rules and we will keep you in touch with developments. If you have a trust, created before Budget day, there is no need to take any immediate action as the IHT charges will not generally take effect until 2008.
 
Small Companies and Their Associates
A decision in the High Court has overturned HMRC’s usual interpretation of the rules on associated companies. The small companies rate of tax of 19% is payable where a company’s profits are less than the upper limit of £300,000. Where the company has associates (broadly companies under common control) the upper limit has to be divided equally between the companies, resulting in the companies paying higher rates of corporation tax if they breach this reduced limit.
 
P11D Dispensations
Last month we reported that forms P11D which report details of employees’ benefits in kind and expenses have to be with HMRC by 6 July. Some of you will no doubt be trying to collate the necessary information to prepare these forms which is a time consuming process.
 
New Funds Available
Two new Enterprise Capital Funds (ECFs) are to be created under a multi-million pound government scheme to boost innovation, jobs and growth for small businesses trapped in the equity gap, Small Business Minister Margaret Hodge has announced.
 
Benefits in Kind Forms P11D are due
It is time to start gathering together the information to complete the forms P11D which report to HMRC details of benefits and expenses provided to employees and directors in the tax year to 5 April 2006. The forms have to be submitted to HMRC by 6 July so you have some time to track down the relevant information and to complete the forms.
 
Charities - Dedicated One Stop Shop Helpline For VAT and TAX Queries
HMRC have set up a specialist office providing advice to charities – and those dealing with charities (individuals and businesses). The HMRC Charities helpline phone number is 08453 02 02 03.
 
New Inheritance TAX Rules
The chancellor, Gordon Brown has revised his proposed Budget measures in respect of trusts, following protests by the life assurance industry and MPs amongst others.
 
Capital Allowances for Smaller Businesses
In Budget 2006, the government announced that capital allowances in the form of first year allowances (FYAs) on plant and machinery acquisitions would be at the rate of 50% for small businesses. The normal rate is 40%. The increased rate will apply for 12 months from April 2006. The rates apply for unincorporated businesses from 6 April and for companies from 1 April 2006.
 
Corporation Tax Rates
A starting rate of corporation tax of 0% was introduced in 2002 and applies to companies with taxable profits of £10,000 or less. Companies with profits between £10,000 and £50,000 enjoy a marginal relief from the small companies rate of 19%. This was followed by the introduction of the non corporate distribution rate of 19% on profits which were distributed by way of dividends back to the shareholders.
 
Jones and Garnett - Off to The Lords
HMRC have been given leave to appeal to the House of Lords so the saga continues.
 
Personal Tax Self Assessment Deadline to Change to September
Tucked away in the vast amount of Budget information are some radical changes which result from Lord Carter’s review of HMRC online services. Businesses and individuals will have to be ready for online filing from as early as 2008.

Employment Pension Contributions

From A Day, 6 April 2006, the new pension regime will finally take effect. We have previously reported on the introduction of the new rules and HMRC have recently published their draft internal guidance on whether or not employer pension contributions will be deductible for tax purposes.

 

PAYE - End of Year Filing

HMRC have published a huge amount of guidance on end of year filing of employers’ returns. Employers with 50 or more employees will have to file electronically this year or face automatic penalties of between £600 and £3000. Smaller employers will again be chasing the £250 tax free incentive payment which is available where they successfully file electronically.

 

Employment Status Tool

HMRC have made available on their website an employment status indicator (ESI) tool which allows contractors to check HMRC’s interpretation of the employment status of potential workers. The tool is aimed at those contractors within the Construction Industry Scheme (CIS) and is being made available in advance of the start to the new scheme, which has been pushed back to 6 April 2007.

Arctic Systems - Revenue to Appeal to The Lords

Last month we reported on the Court of Appeal decision in the Arctic Systems case. Just in case you need a reminder, the case concerned a company owned by a husband and wife and hinged on whether dividends paid by the company to the wife (who was not a higher rate taxpayer) could be taxed instead on her husband (who was a higher rate taxpayer).

 

Car Benefit Calculations

The Revenue have produced updated guidance in the Employment Income Manual on how car benefits are calculated. The guidance sets out the basis for the calculation using the list price of the car and an appropriate percentage normally based on the CO2 emissions of the car. There are lower benefits, and therefore less tax to pay, on energy efficient or ‘green’ cars and the guidance for the benefit calculation for these cars is also included.

 

VAT Receipts and Employee Mileage Claims

In last month’s enews we reported on the changes to the procedures for input VAT recovery by employers on employees’ mileage allowances. Customs have issued further clarification of the evidence required to support a claim for input VAT recovery.

 

Don't Rest On Your Laurels When It Comes To Finance

According to a recent poll, 12 per cent of small businesses across the UK have been subjected to a tax investigation, and this can be far more time consuming than any tax return.

Arctic Systems - The Verdict

At last, a bit of Christmas cheer! No, not from Gordon Brown’s Pre-Budget Report on 5 December, which contained more convoluted ways of raising tax, (but we have come to expect that from the Chancellor!) but from the Court of Appeal.

On Thursday 15 December the judgment in the Arctic Systems case was issued, which creates a little more certainty for tax returns that have to be filed by 31 January 2006. The decision went in the taxpayers’ favour.

In his Pre-Budget Statement the Chancellor announced a complete U-turn on investment by pension schemes after 6th April 2006. He announced that in the interests of encouraging pension savings through diverse investments investment in residential property by SIPPs is no longer to be permitted.
